Department of State Cases Administration
The idea of establishing the State Litigation Administration Department as a specialized department that represents the departments of the Hashemite Kingdom of Jordan before local and international arbitration bodies in cases brought by or against them before the civil judiciary and before the enforcement departments appeared for the first time on 6/1/2010, when issue No. 5034 of the Official Gazette was published, where the term State Litigation Administration Department was first published on page 3052 of that issue. At that time, the temporary law was: Temporary Law No. 14 of 2010 (State Litigation Administration Law (Temporary) of 2010), which came at that time to replace the Government Litigation Law No. (25) of 1958 and its amendments. After its entry into force, which was for eleven months, this temporary law did not last more than 7/1/2010. The Royal Decree approving the Cabinet Resolution No. (646) dated 4/12/2011, which includes declaring the invalidity of the aforementioned temporary law, as this announcement was issued on page 5092 of its publication in the Official Gazette No. 2106 and was issued as of 6/1/2011. Since the invalidity of the temporary law restores the situation to what it was, the courts of the Hashemite Kingdom of Jordan have returned to work in accordance with the Government Claims Law No. (25) of 1958 and its amendments, which is the law published in the Official Gazette No. 1385 on page 546 and effective on 6/1/1958 during the reign of His Majesty the late King Hussein bin Talal, may God have mercy on him. It is the law that was given at the time of its publication to the Deputy, His Majesty the late King Hussein, General Treasury Cases and Legal Cases. The Attorney General assumed this responsibility until 1994, when the amended Law No. 13 of 1994 was issued, entitled the Amended Law on the Formation of Regular Courts for the year 1994, No. 3984, Page 1668, dated 8/1/1994, effective as of 8/31/1994, where the Civil Public Prosecutor and his assistants were appointed, and pursuant to it, the Civil Public Prosecutor’s Department was established, and the position of the lawyer was created, which at that time was affiliated with the Judicial Council and its assistants. The Civil Public Prosecutor and his assistants were appointed by the Judicial Council from among the judges of the highest degree, as well as the Civil Public Prosecutor from among the judges upon the recommendation of the Minister of Justice, where the lawyers were his assistants from among the judges of various degrees. The Judicial Council was aware that the special interest of the Jordanian judiciary was to investigate the legal cases filed by the state departments, which date back to the era of the emirate and accompanied the emergence of the kingdom, as it is not a new matter, but rather its roots are the nomination of the judiciary. Anyone who follows the history of this judiciary will find that during the era of the emirate, His Highness the late King Abdullah bin Al-Hussein had approved it. After the year 1946, His Majesty King Abdullah bin Al-Hussein ordered the issuance of the Government Lawsuits Law of 1935 in the special issue of the Official Gazette No. 468, which was published on page 126 of the Official Gazette and was effective on 2/5/1935. At that time, lawsuits were filed against the deputy under it until the effective date of this judiciary. Then, and from it, and it remained 1/17/1953. After that date, in the Official Gazette No. 1131 and on page 515, Law No. 24 of 1953 was issued, entitled (Government Lawsuits Law of 1953), whose provisions were established as of 1/17/1953. At that time, the Guardianship Council ratified the law on behalf of His Majesty the King and ordered the prosecution to be held by the Attorney General, who continued to issue it. The civil lawsuits associated with this law were established until 25 (of 1958) referred to above, which continued to be issued until the issuance of Government Lawsuits Law No. ) which was established until 12/28/2017 and on 10/18/2016. The State Cases Management Department, pursuant to the amendment of 2/15/2018 to Regulation No. 101 of 2015 (Administrative Organization Regulation of the Ministry of Justice for the year 2015) and its amendments, appeared for the first time within the Ministry of Justice, and this department is still linked to the Minister of Justice with the same organizational structure under Regulation No. 2 of 2022, entitled (Administrative Organization Regulation of the Ministry of Justice for the year 2022), published in the Official Gazette issued on 1/2/2022, which bore the number 5765 and on page 50 of it, effective as of 2/1/2022.
